After playing in a mumble required badwater lobby, I got randomly banned from mumble lobbies. I was in the mumble the entire time, though I muted myself for three minutes because family was around. I've had no other experiences with other mumble related bans and as I said, I was still in the mumble the entire time and was only muted for 3~ minutes, and even that was because I didn't want my family being heard.

Generally if you don't want your background noise to be heard, it's better to use push to talk. Also, the ban has expired at this point.
